TraderZen Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the TraderZen mobile application (the "App") operated by Ziba Online Limited ("we", "our", "us"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Description of Service

TraderZen provides audio content - including Daily Trading Primers, Elite Trader Conditioning Sessions, and binaural beats for mindset support. The App is for informational and entertainment purposes only and does not provide financial, investment, or professional advice.

2. Eligibility

You must be at least 13 years old to use the App. If you are under the legal age of majority in your jurisdiction, you must use the App only under parental or legal guardian supervision and with appropriate consent.

3. Account & Subscriptions

3.1 Account Creation

• You may create an account using your email or via third-party login (Google/Apple). Please provide accurate and current information.

3.2 Free Trial and Subscription Plans

• A one-time 7-day free trial is available per user/device.
• After the trial, you will automatically transition to a Free Basic Plan unless you choose to subscribe to Premium.
• Premium subscriptions are managed through the Apple App Store or Google Play Store.

3.3 Payment, Renewal, and Cancellation

• Your subscription will automatically renew unless canceled at least 24 hours before the end of the current period.
• All payments, cancellations, and refunds are subject to the policies of Apple or Google. You can manage your subscriptions directly through your Apple or Google account settings, and all in-app purchase disputes should refer to their respective policies.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

• Circumvent trial restrictions by creating multiple accounts.
• Extract, reproduce, or share audio content from the App.
• Use the App in any way that is harmful or violates any laws.

We reserve the right to suspend or terminate your access if these Terms are violated.

5. Intellectual Property

All content within TraderZen—including audio content, branding, and user interface designs—is owned by Ziba Online Limited and protected by copyright and intellectual property laws. Unauthorized use is prohibited.

6. Disclaimers and Limitation of Liability

6.1 Disclaimers

• The App provides mindset support and is not a substitute for professional financial, investment, or medical advice.
• We make no guarantees regarding trading performance or results.

6.2 Limitation of Liability

• To the fullest extent permitted by law, Ziba Online Limited shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

6.3 No Financial Advice

• The content provided in TraderZen is for informational purposes only and should not be considered financial or trading advice.

7. Cancellation, Refunds, and Dispute Resolution

7.1 Cancellation and Refunds

• All subscription cancellations, refunds, and billing issues must be processed through Apple or Google, as per their policies.

7.2 Dispute Resolution

• Any disputes arising from these Terms will be resolved through arbitration or mediation in accordance with New Zealand law.
• You agree that any legal action, if necessary, will be conducted in the appropriate courts in New Zealand unless an alternative dispute resolution method is mutually agreed upon.

8. Modifications to Terms

We reserve the right to modify these Terms at any time. Continued use of TraderZen after changes constitutes your acceptance of the updated Terms. We will notify you of significant changes by updating the effective date and posting an in-app notice.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles.

10. App Store Users

For users who download and use the TraderZen app via the Apple App Store, the app is subject to the Apple Media Services Terms and Conditions, which serve as the End User License Agreement (EULA) for the app.
